Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in Meeting Room A on the second floor of the Town Hall.

Public Hearings

7:45 PM Continued Abbreviated Notice of Intent for construction of an addition to replace an existing deck at 32 Country Lane, Assessor’s Map 88, Lot 8-20B with George and Karen Duclos   (DEP #175-414)

George Duclos and his representative, builder Jim Mientkiewicz presented a letter requesting a variance to build an addition to an existing dwelling within the 50-foot buffer zone (attached).  Chairman, Phil Lindquist read the letter.  They presented a plan that had been revised according to the discussion at the previous meeting.  The new plan shows the addition reduced in size and the location of the haybales had been noted.   They also requested permission to build a small deck on the existing patio.

8:00 PM Continued Notice of Intent for construction of an addition and two decks to an existing single family home at 91 Forest Trail, Assessor’s Map 101, Lot 5D-4   with owner Bruce Boyd represented by John Delano, 220 Hudson St., Halifax, MA  (DEP #175-413)

Bruce Boyd presented a letter requesting a variance to build an addition to an existing dwelling within the 50-foot buffer zone (attached).  Chairman, Phil Lindquist read the letter.  Mr. Boyd presented revised plans showing the location an infiltration trench.  Ms. Cassady would like to monitor the living shrub fence closely so it is according to plan.  Also, Ms. Gardner would like the haybale line moved behind the shrub fence after construction.

8:15 PM Continued Request for Determination for construction of a portion of a driveway, crushed stone apron and placement of a well at Elm Street, Assessor’s Map 36, Lot 8-3 with owner Donald Shute.

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Robert J. Ocko of Chilmark Co., Inc. 345 Washington St., Pembroke, MA representing the owner, presented a plan for a driveway and an artisian well.  A portion of the driveway is in the 100-foot buffer zone.  Ms. Cassady noted that there had been a previous filing in 1989 for which there was a positive determination and a statement that any future filings would have to be a Notice of Intent.  Also, there was an old Enforcement Order for destruction of vegetation during excavation along with a restoration plan.  Mr. Lindquist suggested more research on the project was needed.  Ms. Cassady will schedule a site visit.

8:30 PM  Notice of Intent for construction of an addition off a single family house, driveway, and site grading at 131 Whitman St., Assessor’s Map 106, Lot 1-6 with owner James Arena represented by Bob Crowell of Land Planning, Inc., 1115 Main St., Hanson.  (DEP #175-417)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Bob Crowell presented a letter requesting a variance from the 50-foot buffer zone to allow emergency vehicle access to an existing dwelling (attached).    Chairman Phil Lindquist read the letter.  A portion of the driveway is in the buffer zone.  The proposed driveway is 10 feet wide and paved.  The sides will be loamed and seeded.

8:45 PM  Notice of Intent for repair of a sub-surface disposal system at 116 Woodman Terrace, Assessor’s Map 70, Lot  59 with owner Phillip Beaulieu represented by James Engineering, Inc., 125 Great Rock Rd., Hanover, MA  (DEP #175-416)

Mr. Nicholson read the Public Hearing Notice and the green cards were checked.  Gary James and Alan Clemons presented plans for a septic upgrade.  The proposal calls for removal of a cesspool and installation of a 1,500 gallon tank and a retaining wall.  There is a very steep grade and Mr. Lindquist asked that the slope be loamed and seeded.  The Board of Health hearing had been rescheduled for January 27, 2004.  Mr. Grattan explained that the Conservation Commission cannot grant approval until the Board of Health has.  Therefore, the hearing will be continued.  Mr. Lindquist asked for comments from abutters.  Robert McCue attended but had no comments.

9:00 PM Notice of Intent for construction of a single family dwelling, septic and driveway at 411 Brook Street, Assessor’s Map 96, Lot 13B with owner Mary Powell represented by Land Planning, Inc., 1115 Main St., Hanson.  (DEP #175-418)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Bob Crowell of Land Planning, Inc. presented a proposal to demolition the existing trailer on the property and

construct a cape style house behind it.  They would not be altering the grading too much.  Mr. Lindquist requested loaming and seeding.

Orders of Conditions/Determinations of Applicability/Certificates of Compliance

Orders of Conditions for partial construction of dwelling, driveway, well and site grading within the 100’ buffer zone at 90 Pratt Place, Assessor’s Map 89, Lot 1 with Christine Fiske, owner and C.W. Garvey Co., Inc., 36 West St., Whitman, MA  (DEP #175-411) with Special Conditions: The location of haybales and silt fence shall be staked out first and a site inspection shall be scheduled to determine if the haybales and silt fence will be installed in the correct location.  2.  Prior to the commencement of any construction, double staked haybales (with stakes cut level with the top of the bales) and silt fence shall be placed in front of the haybales. 3.  The haybales and silt fence shall be installed at the 50-foot no disturb zone from the isolated land subject to flooding/potential vernal pool.  4.  The haybales and silt fence shall be installed along the 50-foot no disturb zone on the northern side of the property for the protection of the A-series Bordering Vegetated Wetland line.  5.  The 50-foot no disturb zone shall also demarcate the limit of work on the property.  6.  No work shall take place in the 50-foot no disturb zone.  7.  The owner shall give the Conservation Commission permission to investigate the potential vernal pool to the south of the property to see if it is certifiable.  8.  The stream north of the property, which flows into the Indian Head Brook was delineated as perennial with a Mean Annual High waterline.  9.  There shall be a double row of double staked haybales around the area of the proposed well prior to drilling the well.  - signed

Orders of Conditions for construction of a single family dwelling with on-site  septic and grading at Indian Head Street, Assessor’s Map 54, Lot 1-3 with owner Paul Nawazelski represented by John Delano.  (DEP #175-415) with Special Conditions:  1.  The location of the haybales shall be staked out and inspected prior to the installation of said haybales.  2.  After location of the haybales have been approved, they shall be installed with each bale having two stakes and the stakes shall be cut so they are level with the top of the bale.  After installation of haybales, the Commission shall be notified and an inspection shall be scheduled.  3.  The 50-foot buffer zone from the Bordering Vegetated Wetlands shall also be staked out and shall serve as the limit of work.  4.  No other work than what is shown on the approved plans shall take place.  If there are any changes to the approved plan, either a request for an amended Order of Conditions shall be submitted or if changes are very significant, then a new Notice of Intent may have to be filed.  5.  No work shall take place within the 50-foot buffer zone.  6.  Once the yard is stabilized with grass/vegetation, a site visit shall be scheduled and if the land is successfully stabilized, then the haybales shall be removed. - signed

Extension Permit for Orders of Conditions for three years for 278 Monponsett St., Assessor’s Map 31, Lot 13 for Mohamed Nahas of 65 Charles St., Boston, MA, owner (DEP #175-349)

Determination of Applicability for installation of a septic tank, pump chamber and construction of an addition to an existing dwelling at 889 Winter St., Assessor’s Map 114, Lot 8 for Denis Donaghey with special orders:   1. To install double staked haybales as shown on approved plans prior to the start of construction.  2. There shall be an inspection scheduled with the Conservation Commission and/or it’s agent to ensure that the haybales are installed correctly. 3.  Once the septic system installation is completed, the disturbed soil shall be seeded with a grass mix to stabilize the area prior to the removal of the haybales.

Discussions

Ms. Cassady will set up a site visit for Camp Kiwanee, possible on January 24, 2004.  She will notify Commissioners as to the time.

The Commissioner’s decided to issue Donald Norris a Partial Certificate of Compliance for 197 Liberty Street, DEP #175-322 and re-inspect in the spring when the final coat of paving has been completed.  Ms. Cassady had taken pictures of plantings and Mr. Norris has been very forth-coming with keeping this office up to date with progress reports which is appreciated.

Mr. Lindquist notified the Board that the request for more hours for the agent were not put in with the FY/05 budget.  After discussing it with the agent, it was decided that it should wait until next year when the agent will be more available for full time hours.
